Limited Lifetime Warranty
Coverage for this limited lifetime warranty is provided for YKK AP America Inc. vinyl windows and doors installed in the United States of America. Subject to the terms, conditions, and limitations set forth herein, YKK AP America Inc. warrants its vinyl windows and doors after proper installation and under normal use and service to be free from manufacturing defects during the lifetime of the original purchaser while original purchaser retains ownership of the property in which the products are installed ("Limited Lifetime Warranty"). This Limited Lifetime Warranty may not be assigned or transferred and terminates upon the sale of the property by the original owner.
YKK AP America Inc.'s obligation under the Limited Lifetime Warranty is limited to repairing or replacing, at its option, any window or door that is defective in materials or workmanship during the applicable warranty period. Notwithstanding the foregoing, YKK AP America Inc., at its sole discretion, reserves the right to refund the amount paid by the original purchaser for the defective product. YKK AP America Inc. will only cover labor charges to repair or replace defective product for the first two (2) years from YKK AP America Inc.'s invoice date. IN NO EVENT SHALL YKK AP AMERICA INC. BE LIABLE FOR LABOR CHARGES OR OTHER EXPENSES IN CONNECTION WITH REMOVAL OR INSTALLATION OF EITHER THE ORIGINAL OR REPLACEMENT PRODUCT AFTER THE FIRST TWO-YEAR PERIOD.
The Limited Lifetime Warranty shall only apply to individual homeowners. For installations in structures not inhabited by the owner, including, but not limited to corporations, apartments, schools or any other commercial or non-commercial structures, the warranty shall be ten (10) years following YKK AP America Inc.'s invoice date and cover labor charges to repair or replace defective product for the first two (2) years from YKK AP America Inc.'s invoice date ("Limited Warranty"). YKK AP America Inc.'s obligation under the Limited Warranty is limited to repairing or replacing, at its option, any window or door that is defective in materials or workmanship during the applicable warranty period. To the extent any repairs or replacement products are provided to such entities, the Limited Warranty coverage for repaired or replaced products will extend only for the balance of the original Limited Warranty period,IN NO EVENT SHALL YKK AP AMERICA INC. BE LIABLE FOR LABOR CHARGES OR OTHER EXPENSES IN CONNECTION WITH REMOVAL OR INSTALLATION OF EITHER THE ORIGINAL OR REPLACEMENT PRODUCT AFTER THE FIRST TWO-YEAR PERIOD.
For products labeled to contain argon gas, YKK AP America Inc. makes no warranty with respect to the dissipation of argon gas or the amount contained therein at any time after manufacture.
To maintain warranty coverage, vinyl window and door frames and glass surfaces should be cleaned at least two (2) times per year using fresh water and a mild, non-abrasive soap solution.
YKK AP America Inc. reserves the right to discontinue or modify any of its products. If YKK AP America Inc. replaces a product under this warranty, it may substitute products designated by YKK AP America Inc. to be of comparable quality if the originally installed product has been discontinued or modified.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, THE ABOVE LIMITED LIFETIME WARRANTY AND LIMITED WARRANTY ARE MADE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, THAT EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF. IN NO EVENT SHALL YKK AP AMERICA INC. BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DIRECT, SPECIAL, INDIRECT, PUNITIVE, CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND, PERSONAL INJURY, OR REAL OR PERSONAL PROPERTY DAMAGE INCLUDING, WITHOUT LIMITATION, ANY DAMAGE TO ANY BUILDINGS, THEIR CONTENTS OR ANY PERSON THEREIN, RESULTING FROM BREACH OF ANY WARRANTY SET FORTH HEREIN. ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY LAW ARE LIMITED TO THE DURATION OF THIS EXPRESS WARRANTY.
LIMITATIONS.
THE WARRANTIES PROVIDED HEREIN SHALL NOT COVER ANY OF THE FOLLOWING CONDITIONS:
- DAMAGE CAUSED BY IMPROPER STORAGE AND INSTALLATION, VANDALISM, FIRE, FLOOD, ACTS OF GOD, MODIFICATIONS OR ALTERATIONS, SETTLEMENT OR MOVEMENT OF THE STRUCTURE, AIR POLLUTION, EXPOSURE TO HARMFUL CHEMICALS, OR DEFECTS IN SCREENS THAT OCCUR MORE THAN TWELVE (12) MONTHS FROM THE DATE OF YKK AP AMERICA INC.'S INVOICE.
- DAMAGE TO STAINLESS STEEL HARDWARE USED IN YKK AP AMERICA INC.'S PRODUCTS
- NORMAL WEAR AND TEAR, FADING, DISCOLORATION, OR DETERIORATION OF FINISHES OR MATERIALS DUE TO AGE OR EXPOSURE
- MINOR GLASS IMPERFECTIONS OR COSMETIC CONDITIONS THAT DO NOT MATERIALLY AFFECT THE PRODUCT'S STRUCTURAL INTEGRITY OR SUBSTANTIALLY IMPAIR NORMAL VISION
- GLASS BREAKAGE OR CRACKS NOT RESULTING FROM A MANUFACTURING DEFECT
- PRODUCT NOT PAID FOR IN FULL OR NOT PURCHASED THROUGH AN AUTHORIZED DEALER
- PRODUCTS INSTALLED AT ALTITUDES ABOVE 3,500 FEET WITHOUT PROPER CAPILLARY OR BREATHER TUBES
- DAMAGE RESULTING FROM APPLICATION OF AFTERMARKET WINDOW FILMS, TINTS, COATINGS, OR OTHER MODIFICATIONS NOT PERFORMED OR AUTHORIZED BY YKK AP AMERICA INC.
- DAMAGE RESULTING FROM USE OR CONDITIONS OUTSIDE THE PRODUCT'S DESIGN LIMITATIONS, INCLUDING BUT NOT LIMITED TO EXCESSIVE LOCALIZED HEAT, HIGH HUMIDITY, HIGH-MOISTURE ENVIRONMENTS, AGGRESSIVE ATMOSPHERES INCLUDING EXPOSURE TO SALT SPRAY AND/OR SALT MIST, OR COASTAL ENVIRONMENTS
- DAMAGE CAUSED BY INSECTS, ANIMALS, OR PESTS
- DAMAGE RESULTING FROM INADEQUATE BUILDING DESIGN, CONSTRUCTION, OR MAINTENANCE, INCLUDING IMPROPER MOISTURE MANAGEMENT
- DAMAGE RESULTING FROM IMPROPER MAINTENANCE OR CLEANING, INCLUDING USE OF HARSH, ABRASIVE, OR NON-RECOMMENDED CHEMICALS, SOLVENTS, RAZOR BLADES, OR PRESSURE WASHING EQUIPMENT.
NO FIELD REPRESENTATIVE, DISTRIBUTOR, CONTRACTOR, INSTALLER OR DEALER OF YKK AP AMERICA INC. PRODUCTS IS AUTHORIZED TO MAKE ANY CHANGE OR MODIFICATION TO THE WARRANTIES PROVIDED HEREIN.
SOME STATES DO NOT ALLOW LIMITATIONS ON, OR THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
