NIKON BINOCULAR, RANGEFINDING BINOCULAR AND FIELDSCOPE LIFETIME LIMITED WARRANTY NIKON BINOCULAR, RANGEFINDING BINOCULAR AND FIELDSCOPE LIFETIME LIMITED WARRANTY THIS IS YOUR NIKON INC. (VALID IN THE CONTINENTAL UNITED STATES, HAWAII, CENTRAL AND SOUTH AMERICA, AND THE CARIBBEAN) (“NIKON”) LIMITED WARRANTY FOR NEW NIKON BINOCULARS, RANGEFINDING BINOCULARS AND FIELDSCOPES. YOU MUST PRESENT THIS FORM TOGETHER WITH YOUR PURCHASE RECEIPT THAT DISPLAYS THE PURCHASE DATE TO OBTAIN WARRANTY SERVICE. Nikon’s Lifetime Limited Warranty applies to the optical system components of this Nikon Binocular, Rangefinding Binocular or Fieldscope, which optical system components are warranted by Nikon to be free from defects in material and workmanship for the lifetime of the product from the date of purchase by the original consumer purchaser from a Nikon authorized dealer. Nikon’s Seven Year Limited Warranty applies to the non-optical system components of this Nikon Binocular, Rangefinding Binocular or Fieldscope, which non-optical system components are warranted by Nikon to be free from defects in material and workmanship for seven years from the date of purchase by the original consumer purchaser from a Nikon authorized dealer. Nikon’s One Year Limited Warranty applies to the electronic components, if any, of this Nikon Binocular, Rangefinding Binocular or Fieldscope, which electronic components, if any, are warranted by Nikon to be free from defects in material and workmanship for one year from the date of purchase by the original consumer purchaser from a Nikon authorized dealer. During the Lifetime of the Product, Seven Year or One Year time period stated above that applies, if a component of this Binocular, Rangefinding Binocular or Fieldscope is found to be defective in material or workmanship, Nikon will at its option, either repair or replace this Binocular, Rangefinding Binocular or Fieldscope, with a product of comparable specifications and value, without charge, or refund the purchase price shown on your purchase receipt, subject to the following conditions, limitations and exclusions: This warranty extends to the original consumer purchaser only and is not assignable or transferable. This warranty shall not apply to any product which has been subjected to misuse, abuse, abnormal use, negligence, alteration, accident, power surge if the product contains electronic components, or has had its serial number altered or removed. This warranty does not apply to any defects or damage directly or indirectly caused by or resulting from the use of unauthorized replacement parts and/or service performed by unauthorized personnel. This warranty does not apply to any batteries. THIS WARRANTY IS MADE EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT, AND ALL OTHER OBLIGATIONS ON THE PART OF NIKON PROVIDED, HOWEVER, THAT IF THE DISCLAIMER OF IMPLIED WARRANTIES IS INEFFECTIVE UNDER APPLICABLE LAW, THE DURATION OF ANY IMPLIED WARRANTIES ARISING BY OPERATION OF LAW SHALL BE LIMITED TO THE LIFETIME OF THE PRODUCT, SEVEN YEAR OR ONE YEAR TIME PERIOD STATED ABOVE THAT APPLIESFROM THE DATE OF PURCHASE OR SUCH LONGER PERIOD AS MAY BE REQUIRED BY APPLICABLE LAW. NIKON HEREBY DISCLAIMS ANY AND ALL LIABILITY FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL, INDIRECT, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH ANY BREACH OF THIS WARRANTY OR ANY OTHER CLAIM WITH RESPECT TO THIS BINOCULAR, RANGEFINDING BINOCULAR OR FIELDSCOPE, INCLUDING BUT NOT LIMITED TO, CLAIMS OF NEGLIGENCE, STRICT LIABILITY IN TORT OR BREACH OF CONTRACT. SOME STATES DO NOT ALLOW (A) LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR (B) THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. To obtain performance of the warranty obligations, the original consumer purchaser must return this Nikon product together with this warranty form and the purchase receipt displaying the purchase date to the appropriate Nikon service facility. In returning this Nikon product for repair or replacement or refund under this warranty, the original consumer purchaser must prepay all postage, shipping transportation, insurance and delivery costs, and the Nikon product must be delivered in either its original carton or a similar package affording an equal degree of protection. Nikon will not be responsible for any loss or damage incurred in connection with the return of this Nikon product. THIS WARRANTY FORM MAY NOT BE REPRODUCED OR COPIED AND WILL BE VALID ONLY WITH AUTHENTIC BINOCULARS, RANGEFINDING BINOCULARS OR FIELDSCOPES SOLD BY NIKON AND PURCHASED FROM A NIKON AUTHORIZED DEALER.
